Among the wide variety of experiences linked to academic work, there are some intense affective experiences that are more directly related to the conceptual development that the learners will achieve because they are intrinsically linked to the activity displayed during the acquisition of knowledge, such is the case of curiosity, confusion and surprise. These epistemic emotions that occur during learning activities are aimed at the conceptual content of the individual's beliefs. The objective of this work is to theoretically explore the (...) idea that the conceptual development that occurs in educational contexts depends on the development of an affective tendency with an intersubjective base that serves as a background to the advent of epistemic emotions in social learning situations. The confidence with which a learning situation is faced is a general tendency (an epistemic attitude) fruit of the individual's trajectory that functions as a background for the activities in which knowledge is acquired. An adequate understanding of the relationships between epistemic emotions, confidence and knowledge can generate ideas that promote the consolidation of this attitude as a facet of learning in school. As pedagogical implications of this conceptual model, some common epistemic emotional patterns are presented in asymmetrical relationships between teachers and children. (shrink)

ABSTRACT This article aims to analyze the process of mutual understanding from the perspective of Discursive Neurolinguistics. As a methodology, a case study was carried out on a child with a linguistic profile of verbal restriction, which concerns the dimension of utterances involving words and their morphology. Data interpretation was based on the Bakhtinian perspective, which addresses ‘understanding’ as an active-responsive process and meaning as emerging from the relationship between utterances. The results showed that the interlocutors’ common ground allowed the (...) joint construction of meaning even in the face of verbal restrictions, and aspects such as nonverbal elements and the recognition of the child’s active-responsive role also favored mutual understanding. As a conclusion, the attention to different multimodal resources as legitimate modes of expression allows children with verbal restrictions to fulfill the role of “speakers” regardless of their modes of expression. RESUMO O objetivo deste trabalho é analisar implicações subjetivas decorrentes do processo de patologização da educação. Para tanto, foram realizadas entrevistas com duas crianças com diagnóstico de Transtorno de Déficit de Atenção/Hiperatividade, seus pais e professores, observação em sala de aula, avaliação fonoaudiológica individual e pesquisa documental. Os resultados do estudo apontam que os discursos que se instauram em torno do aluno considerado resistente ao que a escola propõe terminam por comprometer a formação da sua subjetividade, uma vez que ele (...) passa a assimilar parte das percepções de seu grupo de convivência. Assumindo os postulados de Bakhtin, de que a autoimagem se constrói em meio ao olhar do outro, conclui-se que a criança pode apresentar sinais de desatenção e hiperatividade a depender da qualidade das interações sociais em que está inserida. ABSTRACT The aim of this article is to analyze subjective implications arising from the process of pathologization of education. Therefore, interviews were conducted with two children diagnosed with attention deficit/hyperactivity disorder, their parents and teachers, in addition to in-classroom observation, individual speech-language pathology assessment and documentary research. The results of the study indicate that the discourses, established around students considered resistant to what the school proposes, eventually compromise the shaping of his or her subjectivity, since they start to assimilate part of the perceptions of their interactional group. Based on Bakhtin’s postulates that self-image is built in the midst of the other’s gaze, it is concluded that the child may present signs of inattention and hyperactivity depending on the quality of the social interactions in which he/she is engaged. El 28 de junio de 2002, en la UNAM, se iniciaron diversas actividades academicas con las que se rindio una serie de homenajes nacionales e internacionales al filosofo mexicano mas universal, Leopoldo Zea, para celebrar sus 60 anos de labor academica y por haber llegado a sus fecundos 90 anos de vida. El presente volumen recoge los textos escritos con motivo de dichos homenajes.

This article argues that thinking about entrepreneurship as a potential instrument for relief from endemic poverty and disadvantage, especially among the Indigenous, has all too often been captive to a concept of entrepreneurship that is built out of constrained economic and cultural assumptions. The authors develop this argument from a critical discussion of contributions by Karl Polanyi and Robert Heilbroner. The result is that approaches to venture have been encouraged that are sometimes a poor fit for the circumstances of those (...) they are meant to benefit, and other forms that could have considerable promise have gone unexplored. This article outlines some features of Indigenous culture and build on the analysis of David Harper to construct an improved notion of entrepreneurship that allows for these distinctive features. The article concludes that research and policy making concerning entrepreneurship as an instrument of development among the Indigenous need to be undertaken with this reconstructed understanding of entrepreneurship that is a better fit for the realities of Indigenous culture. Drawing from Goffman’s original observations on stigma and the consequences of interactions between the stigmatized and supportive or stigmatizing audiences, we conduct a 20-year review of the diverse literature on stigma to revisit the collective nature of stigmatization processes. We find that studies on stigma’s origins, responses, processes, and outcomes have diverged from Goffman’s relational view of stigma as they have overlooked important relational mechanisms explaining the processes of (de)stigmatization. We draw from those conclusions to justify the need to study (...) stigma as a collective phenomenon. We develop a relational perspective on stigma based on understanding how attributes are stigmatized (or not) by audiences in their interactions. We argue that to advance stigma research, it is necessary to build on Goffman’s theory to include the stigmatizers (i.e., the normal) and supporters (i.e., the wise); how they create, sustain, or remove stigma; and how they relate to the stigmatized (i.e., the targets). Accordingly, we provide a research agenda on stigma as a collective phenomenon that theorizes a relational perspective, proposes a typology of how audiences relate to stigmatization, and identifies patterns of relations between audiences. We thus offer a missing piece to existing accounts of stigma by focusing on the key role of audiences (i.e., stigmatizers or supporters of the stigmatized) rather than on the targets of stigma (i.e., the own). Authentic leadership has become increasingly important in the literature, attracting the attention of many scholars in the last decade. This study adopted an employee-centered perspective to guide its examination of the relationship between authentic leadership and individual performance and investigation of the sequential mediation of employees’ affective commitment and individual creativity. An analysis was conducted of data collected from 214 employees working in different business sectors. The results reveal a statistically significant positive relationship between authentic leadership and employees’ workplace performance, (...) which are both directly connected and indirectly linked through the two proposed psychosocial mechanisms. The findings thus indicate that authentic leadership reinforces workers’ emotional connection with their organizations, thereby increasing their individual creativity and, subsequently, promoting better on-the-job performance. This study presents new and significant results since, on the one hand, it relied on a sequential mediation analysis of variables and, on the other hand, integrated the four main constructs into a single model. The proposed model displays the chain of effects between authentic leadership, affective commitment, individual creativity, and employee workplace performance. In 2020, the European Union announced the award of the contract for the biometric part of the new database for border control, the Entry Exit System, to two companies: IDEMIA and Sopra Steria. Both companies had been previously involved in the development of databases for border and migration management. While there has been a growing amount of publicly available documents that show what kind of technologies are being implemented, for how much money, and by whom, there has been limited engagement (...) with digital methods in this field. Moreover, critical border and security scholarship has largely focused on qualitative and ethnographic methods. Building on a data feminist approach, we propose a transdisciplinary methodology that goes beyond binaries of qualitative/quantitative and opacity/transparency, examines power asymmetries and makes the labour of coding visible. Empirically, we build and analyse a dataset of the contracts awarded by two European Union agencies key to its border management policies – the European Agency for Large-Scale Information Systems (eu-LISA) and the European Border and Coast Guard Agency (Frontex). We supplement the digital analysis and visualisation of networks of companies with close reading of tender documents. In so doing, we show how a transdisciplinary methodology can be a device for making datafication ‘intelligible’ at the European Union borders. (shrink)

Nursing Sciences are at a moment of paradigmatic transition. The aim of this paper is to reflect on the new epistemological paradigms of nursing science from a critical approach. In this paper, we identified and analysed some new research lines and trends which anticipate the reorganization of nursing sciences and the paradigms emerging from nursing care: biotechnology‐centred knowledge; the interface between nursing knowledge and new information technologies; body care centred knowledge; the human body as a cyborg body; and the rediscovery (...) of an aesthetic knowledge in nursing care. Studies of creative industries typically contend that creative work is profoundly precarious, taking place on a freelance basis in highly competitive, individualized and contingent labour markets. Such studies depict creative workers as correspondingly self-enterprising, self-reliant, self-interested and calculative agents who valorise care-free independence. In contrast, we adopt the ‘ethics of care’ approach to explore, recognize and appreciate the communitarian, relational and moral considerations as well as interpersonal connectedness and interdependencies that underpin creative work. Drawing on in-depth interviews with creative workers (...) in a range of marginal socio-cultural contexts, we argue that creative workers cultivate and sustain a diverse array of practices of care arising from an affective concern with the well-being of others. Far from being merely individualistic and crudely competitive actors, creative workers enact practical ethical responsibilities and affectivities towards a range of human and non-human others, including families, local communities and neighbourhoods, colleagues, artistic scenes and their adjacent genres, and surrounding national and linguistic cultures. In emphasizing the fundamental and structuring role of care in contingent labour markets our approach accords with recent trends in the social sciences that ‘affirmatively’—as opposed to ‘negatively’ and ‘suspiciously’—recognize that mutuality, solidarity and affectivity are powerful drivers of action on a par with or even exceeding market-driven self-centredness. Margaret Archer plays a leading role in the sociological analysis of the relation between structure and agency, and particularly in the study of reflexivity. The main aim of this article is to discuss her approach, focusing on the main contributions and limitations of Archer’s theory of reflexivity. It is argued that even though her research is a pioneering one, proposing an operationalization of the concept of reflexivity in view of its empirical implementation, it also minimizes crucial social factors and the (...) dimensions necessary for a more complex and multi-dimensional study of the concept, such as social origins, family socialization, processes of internalization of exteriority, the role of other structure–agency mediation mechanisms and the persistence of social reproduction. Collaborative cross-sector business models for sustainability innovation (CCSBMSI) in response to grand challenges are rich foci for tensions. This is the case of CCSBMSI targeting independent living through Information and Communication Technology–enabled care. This research aims at identifying the relevant tensions, understanding their interactions, and assessing how they can be effectively managed so that CCSBMSI become more valuable for partners and transformative for society. A conceptual framework that understands the management of interrelated institutional and interorganizational tensions as a dynamic capability (...) is substantiated through in-depth, qualitative analysis of the long-term dynamics of a four-sector CCSBMSI in telecare—including government, businesses, nonprofits, and informal actors. Its effects on the transition of business models in terms of value creation, delivery, and capture; on relevant stakeholders—particularly nonprofits and beneficiaries; and on the development of the sustainability innovation are discussed. In this study, we aim to disentangle pantomime from early signs in a newly-born sign language: Sao Tome and Principe Sign Language. Our results show that within 2 years of their first contact with one another, a community of 100 participants interacting everyday was able to build a shared language. The growth of linguistic systematicity, which included a decrease in use of pantomime, reduction of the amplitude of signs and an increase in articulation economy, showcases a learning, and social interaction (...) process that constitutes a continuum and not a cut-off system. The human cognitive system is endowed with mechanisms for symbolization that allow the process of arbitrariness to unfold and the expansion of linguistic complexity. Our study helps to clarify the role of pantomime in a new sign language and how this role might be linked with language itself, showing implications for language evolution research. (shrink)

The International Criminal Court (ICC) is responsible for prosecuting individuals for heinous crimes that take place during civil and/or international armed conflicts, including sexual violence. Prosecuting this crime relies primarily on survivor accounts, but witnesses often fear the psychological effects of giving such testimony, particularly because there is a high risk of retraumatization, a stigma associated with victimhood, and a fear of victim-blaming. Thus, the Court’s Victims and Witness Unit (VWU) puts forth provisions for questioning vulnerable witnesses, requiring, in part, (...) that questioners avoid embarrassing or offending witnesses. Using a discourse analytic approach, this paper examines transcripts from three recent ICC cases dealing with wartime sexual violence—_Bemba, Ongwen_, and _Katanga and Chui—_exploring the discursive strategies employed by prosecutors and defense attorneys in these trials as they navigate arguing their cases before the judges while also tailoring their questions to adhere to the VWU’s provisions. I show that adhering to the provisions often involves relying on euphemistic expressions to discuss rape—which enter the trial discourse through linguistic formulations and reformulations—even though these expressions reflect the language used to discuss consensual sex and not sexual violence. Thus, this method of adhering to the provisions can undermine the prosecution’s case while helping the defense’s. (shrink)

As one tries to grasp love and its images within José Leonilson's production, a multiplicity of aspects and meanings are seen that also relate to Louise Bourgeois's oeuvre in regard to the interest in human relations. Through a comparative approach to both artists' poetics, an understanding is created that love is not a simplistic action and all the words read in or applied to their visual discourse must be considered within a wide range of love in visual and literary images. This paper considers the UN efforts to introduce a legally binding Treaty on corporate accountability for human rights impacts in the context of other proposed legislation at country level, on the one hand, and existing voluntary initiatives like the UN Guiding Principles (2011), on the other. What we are interested in is whether the proposed Treaty signals a transition from voluntary initiatives (based on moral commitments) to law (that is, a focus on compliance), and the extent to which it might (...) stimulate or hinder links between judicial and non-judicial initiatives. The scholars who have explicitly addressed these two divides are – Michael Sandel, on theory v. practice; and Amartya Sen, on law v. morality. We engage with their views, in sections II and III respectively, seeking to build an integrated approach to help us overcome these dualisms. We further consider John Ruggie’s “principled pragmatism”, a strategy that he uses to build the Protect, Respect and Remedy (henceforth, PRR) Framework; and we invoke arguments from casuistry as well as a practice-focused deontology (Thomas Donaldson’s) in favour of an ethics ‘beyond cognition’, which we consider better suited than either utilitarian or principle-based theories to guide the debate on human rights. This is because it allows us to take non-rational factors into account (such as emotions and personal affiliations), when judging the kind of common good we consider worth pursuing. In the last section of the paper, we investigate whether and how might the Treaty illustrate the two divides, trying to (a) distinguish between purely legal elements and those of a wider nature, to do with morality; and (b) understand what might help bridge the gap between theoretical commitments to the universality of human rights and various practical challenges. Our aim is not to evaluate the Treaty, from a legal viewpoint, or suggest improvements to it (lawyers are better placed to do that); rather, we seek to investigate the way in which the proposed Treaty – which is the first attempt to address the challenge of transnational business and human rights in international law – combines moral and legal aspects, and what this tells us about the world we live in. We introduce the papers in this special issue by providing an overarching perspective on the variety in kinds of commons and the ethical issues stemming from their diversity. Despite a long history of local commons management, recent decades have witnessed a surge of scholarly interest in the concept of “the commons,” including a growing management literature. This swell was impelled especially by Garrett Hardin’s paper of 1968, and the body of work generated by Elinor Ostrom and her colleagues. However, the (...) term itself has come to be used in a variety of ways. To contextualize its ethical dimensions, we map a number of commons-related concepts such as common-pool resources, common property regime, excludability and subtractability, common-pool resource types and commons or “commoning” as a source of production. Following a brief summary of papers in this special issue, the essay concludes with an identification of implications for research, practice and policy. (shrink)

In this paper, the different theories about science and technology relationships are analyzed. All of them have some virtues, but also one main defect: these theories do not take into account other well-founded possible relationships. The origin of this problem is the narrow view about science and technology. In this paper another characterization about technology based on Ronald Giere’s perspective is suggested. In the light of this new description, six different relationships between science and technology arise. International criminal law (ICL) has traditionally overlooked sexual and gender-based violence (SGBV) and struggles to understand it. Prosecutions have been largely inefficient and not reflective of gender harms. The Rome Statute requires interpreting SGBV as a social construction (article 7(3)), in consistency with international human rights law (IHRL) and without discrimination (article 21(3)). There is, however, little guidance to implement these approaches. This article argues that intersectionality, an IHRL-based approach that reveals compounded discrimination, is an efficient tool to interpret SGBV (...) and, therefore, should be integrated in ICL. The article traces the origins of intersectionality in feminism and its recognition by IHRL dealing with violence against women. It establishes the applicability of intersectionality in ICL that it demonstrates with a comparative analysis of the Lubanga and Ntaganda cases. The findings show that intersectionality suits ICL’s specific needs which allows labelling and explaining some of those contributions throughout the judicial process. (shrink)

Este artículo1 explora dos obras cinematográficas guatemaltecas, Polvo (2012) y Nuestras madres (2019), dirigidas por Julio Hernández Cordón y César Díaz correspondientemente. En ambos largometrajes la denuncia sobre la violación de derechos humanos durante el pasado conflicto armado guatemalteco, la búsqueda de padres o familiares desaparecidos y sus secuelas en las víctimas constituyen la temática central. Por tanto, el análisis se centra en la importancia que tiene la búsqueda del padre desaparecido en los hijos, quienes, a raíz de esta vivencia (...) traumática, experimentan un vacío identitario, así como estragos individuales provocados por la falta de la figura paterna. Por otro lado, también se analizan el trauma y el silencio de las madres sobrevivientes como remanente del miedo/terror experimentado durante el conflicto armado, pero también como un mecanismo de protección para sus hijos. La novela de Ishiguro _ Nunca me abandones _ (2005) suele calificarse de distópica, asumiendo que refleja una inaceptable injusticia al plantear la explotación de clones de humanos, ‘donadores’ de órganos para sus humanos originales. Empero, el concepto de distopía no puede caracterizar la situación descrita de manera absoluta, pues para la humanidad original realmente no hay un mal funcionamiento social; por su parte, a pesar de padecer enajenación orgánica y la restricción a su libertad, en la novela no hay (...) rebeliones de clones o crisis humanitaria sufrida por los clones. Pudiendo reflejar una utopía, provoca indignación y se categoriza como distopía en el supuesto de que los clones son también humanos o deberían contar como tales, pues así lo parecen. La parcialidad de la categorización distópica revela cierto prejuicio que impide ver que tal es la condición que el ganado enfrenta actualmente en nuestras sociedades. Su explotación no se categoriza como distópica ni injusta, a pesar de que comparte la misma forma de legitimidad en su explotación que los clones (‘para eso son’) y la misma limitación para articular por sí solos la resistencia de manera colectiva y sistemática. Conecto esta reflexión con el análisis de dos ámbitos en los que los animales no humanos son usados para fines no humanos: la experimentación biomédica y la ganadería. (shrink)

This article develops further a proposal for conversation at the ASC 2020 Global Conversation event, motivated by exchange of e-mails with Ranulph Glanville in 2007. Drawing from the questions raised by Glanville and myself, this article addresses the concept of autopoiesis and the possibility of revisiting the concepts of structure and organization, which are discussed with an example of a transfunctional interface (structure) designed to invite people to configure unpredictable organizations. One of the most characteristic features of Comparative Literature in terms of methodological practice is that of operating in “in between” spaces. Not only does this feature suggest the comparative approach as something which originates through movement, thus making it imperative for the researcher to deal with the notion of mobility, it also characterizes many of the concepts with which it operates. Considering the possibility, as well as the fertility, of practicing this methodology in the analysis and critique of contemporary (...) visual art, we understand that it fits the analysis of any enterprise regarding the in-betweens of visual and verbal texts. These fundamental aspects were elected for a comparative analysis of two visuals artists whose œuvres operate in in-between spaces between the visual and the verbal as much as between the self and the Other. José Leonilson (Brazil 1957-1993) and Louise Bourgeois (France/EUA 1911-2010) reveal, through a comparative analysis, creative and constitutive actions which elaborate a space we could best understand through the image of a seaside landscape where the line we try to draw to divide the saltwater from the sand never stands. But, in what manners could the constituted poetic space created by them be of significance for a broader spectrum than the literary interest? In our understanding, Leonilson’s and Bourgeois’s poetics operate through a silent hearing of the Other, might that be their loved ones, the stone or cloths. This conceptual notion, required for the creative action, thus establishes a particular notion of balance between them and the Other. It is this precise aspect that also operates the mobility of the notion of love through their œuvre, and through the election of personal emotional narratives as the thriving force for creation. And what could be more needed nowadays, here as elsewhere, than considering together with Leonilson’s and Bourgeois’ images that love shall be the perpetual moving space that at times nears, and later distances us from each other? The literature studying the characteristics associated with revictimization in Intimate Partner Violence is heterogeneous and inconclusive. The absence of studies on the role of the emotional variables of the victims and the failure to distinguish revictimization by the same or different aggressors are two of the main limitations in this area of research. The aim of this work was to study the relative contribution of the material, social, and emotional resources available to IPV victims in predicting revictimization by the same (...) or different perpetrators. The sample consisted of 290 women registered in the city of Madrid who had filed at least one police report for intimate partner violence. The material resources of the victims were evaluated through their level of monthly income and employability status, the social resources through perceived social support, and the emotional resources through emotional regulation and coping strategies. Hierarchical multinomial logistic regression models were estimated to predict single-offender victimization, same-offender revictimization, and multiple-offender revictimization. The results revealed that: differentiating between revictimization by the same and different aggressors improved the fit of the model by 50.8% compared to when only differentiating between victimized and revictimized women; material resources had no significant weight in the prediction of any type of revictimization; SRV women had more social support than VSRDA women ;, those victims who had made several reports to the authorities of violence by different aggressors, had worse emotional regulation than those victims who had made a single report to the authorities ; and VSRDA obtained the worst mental health indexes and they used more coping strategies based on positive reappraisal than the VSR women and those victims with several reports by the same aggressor. These results show that being a victim of several episodes of intimate partner violence by different aggressors should be understood as a form of revictimization of great severity associated with worse emotional regulation and less social support. Em Aristóteles, o prazer pode fazer o homem cometer atos vis, enquanto a dor pode impedi-lo de realizar atos nobres. Por isso, para o autor, é preciso ponderar prazer e dor pelo hábito, de tal modo a tornar-se um homem virtuoso, que sente prazer ao realizar ações nobres. Diferentemente, para Kant, uma ação perde seu valor moral caso seja realizada por causa de alguma inclinação, ou seja, se uma ação foi realizada com prazer, ainda que ela seja correta, ela perde (...) o valor moral. De um lado oposto, temos Mill, que considera moral o que traz felicidade, e a felicidade é gerada pela maximização do prazer e minimização da dor. Ainda que com tratamento diferenciado, estas três correntes relacionam o estudo da moral aos sentimentos, o que consideramos um erro. Defendemos que o certo e o errado devem ser analisados de forma lógica e racional para o atingimento de determinada finalidade, de tal modo que o sentimento gerado pela ação não pode ser capaz de dignificar juízos morais e nem de ser fundamento para a constituição dos mesmos. Descrito por Frei Agostinho de Santa Maria no Santuário Mariano, o culto de Nossa Senhora das Brotas, padroeira dos animais doentes, tem como origem um suposto milagre ocorrido na localidade de Brotas no Alto Alentejo, no início do século XV. Culto rural, com base numa história simples entre um pastor e a sua vaca, a lenda de Nossa Senhora de Brotas é um curioso exemplo de regionalismo na iconografia mariana.

Estudo comparado sobre o tratamento dado à reprodução humana assistida no direito do Brasil, Estados Unidos, Portugal, Espanha e Itália.

O artigo examina a descriçáo e a crítica nietzscheanas do método dialético socrático, bem como o método de investigaçáo nietzscheano – a genealogia. Nietzsche considera o ser humano um criador de conceitos e de métodos de investigaçáo. Os métodos de investigaçáo, por sua vez, sáo associados a tipos humanos e a suas formas de relacionamento com a realidade efetiva. Dworkin respondeu afirmativamente à pergunta título do seu texto “Não existe mesmo nenhuma resposta certa em casos controversos?”. Posner criticou Dworkin e respondeu a mesma pergunta negativamente. Discute-se neste artigo as diferentes maneiras como cada filósofo entendeu a pergunta que acarreta diferentes respostas a ela, isto é, de que modo diferenças na concepção do que é o Direito acarretam diferenças a respeito da existência de respostas certas para questões jurídicas.

Toma-se a crítica de Nietzsche a Sócrates como um caso exemplar que mostra os dois sentidos fundamentais da crítica nietzscheana: (i) a crítica nietzscheana consiste em censura e em elogio de modo dual, ou seja, censura e elogio são aspectos da crítica; e (ii) ao criticar alguém, Nietzsche está, igualmente, se autocriticando.

This book brings together a number of contributions dealing with certain fundamental structures of practical rationality, as they are presented in the areas of the philosophy of action and normative ethics, namely: intentionality, normativity, and reflexivity. With the term “intentionality,” is meant a set of problems that are linked not only with the teleological structure of praxis-oriented rationality, but also with its temporal structure. “Normativity”, in turn, refers to a distinct set of problems, which cannot simply be reduced to those (...) entailed in the intentional nature of human action, even if this notion incorporates a reference to the good or value in its very structure. Finally, with the term “reflexivity” we point at the linkage between the normative dimension of reason with both the contingent circumstances of action and the moral receptivity of the agent, as it is experienced in moral judgment.
